Governor Newsom’s Executive Order N-28-20, which provides renters certain protections from eviction and homeowners from mortgage foreclosures during the COVID-19 state of emergency and the City of Encinitas companion Urgency Ordinance 2020-07 expire on September 30, 2020.

On August 31, 2020, the State of California enacted Assembly Bill 3088 (AB 3088) to extend some of those protections and set certain requirements for both landlords and tenants.  It is important to note that while the City of Encinitas Eviction Moratorium provided protections for Commercial leases, AB 3088 does not, and those protections expire on September 30, 2020.  Reading and understanding AB 3088 is important for landlords and tenants.  The full Bill can be found HERE, and you can read a Factsheet HERE.  The State has also created an interactive guide to assist tenants and landlords in knowing their rights and options.

The City of Encinitas contracts with the Legal Aid Society of San Diego to provide fair housing services for Encinitas residents and housing providers at no cost.  More information on AB 3088 is available on their webpage at www.lassd.org or contact them with your questions at (844) 449-3500.

If you have questions for the City, please call (760) 633-2723.
