Equal access to housing is a right guaranteed to everyone. Fair Housing laws prohibit discrimination in the sale or rental of housing based on State and Federal protected classes, such as race, religion, national origin, family status, disability, sexual preference, source of income, or any arbitrary status.

As part of their Community Development Block Grant (CDBG) program, the City of Encinitas contracts with Legal Aid Society of San Diego to provide fair housing services for Encinitas residents and housing providers at no cost. The City refers complaints to Legal Aid, which mediates and assists with filing fair housing complaints. Legal Aid also offers several educational tools, including workshops and written materials, and conducts testing to ascertain if fair housing issues are occurring in the City.

The Community Law Project is a non-profit organization within California Western School of Law that provides brief legal advice, legal referrals, and free consultations (rotating volunteer attorneys with different legal specializations).

San Diego Regional Analysis of Impediments to Fair Housing Choice - A review of impediments or barriers that affect the rights of fair housing choice

As a recipient of federal funds to administer housing and community development programs, the City of Encinitas must affirmatively further fair housing. Part of this effort includes completion of an Analysis of Impediments to Fair Housing Choice (AI) approximately every five years. The AI evaluates the nature and extent of housing discrimination and examines factors that may impede housing choice.
