Housing Element Certification Letter
The Housing Plan Update 2019 was prepared based on Council direction received at their meeting of December 12, 2018 in response to the order of the San Diego Superior Court issued on December 12, 2018, which requires the City to adopt a Housing Element consistent with State law within 120 days (April 11, 2019). At the December 12th meeting, the City Council also directed staff to submit a draft Housing Element by December 21, 2018 to the State Department of Housing and Community Development (HCD) for review. According to the proposed Housing Element draft, "The Housing Element Update provides the City with a coordinated and comprehensive strategy for promoting the production of safe, decent, and affordable housing for all within the Encinitas community."
2013-2021 Housing Element
The Housing Plan Update 2019 includes the 2013 - 2021 Housing Element Update and a series of discretionary actions to update and implement the City’s Housing Element. On March 13, 2019, the City Council considered the project and unanimously approved Resolution 2019-19 adopting the Housing Element Update.
Additionally, on March 27, 2019 the City Council completed one of the last steps remaining to complete the fifth cycle Housing Element by adopting Ordinance No. 2019-04. The ordinance enacts amendments and text/map changes to the Local Coastal Program, Municipal and Zoning Codes, and three specific plans to implement the Housing Plan Update 2019 by providing adequate sites with corresponding zoning and development standards to meet the City's Regional Housing Needs Assessment allocation.
The final steps remaining for the Housing Plan Update 2019 include receiving certification from the State Department of Housing and Community Development (HCD) and Local Coastal Program (LCP) Amendment approval from the California Coastal Commission. The Housing Plan Update 2019 was submitted to HCD on March 15, 2019 for final review. Additionally, the Local Coastal Program amendment was submitted to the California Coastal Commission on March 18, 2019. On June 13, 2019, the California Coastal Commission unanimously approved the LCP amendment with one modification to the permitted uses on the Jackel Property (Site No. 7). The modification was presented to the City Council for their acceptance the modification and consider an Introduction of Ordinance to incorporate the modification on July 10, 2019. On August 21, 2019, the City Council will hold a public hearing for the second reading of the Ordinance.
Upon City Council approval of the modification, City staff will submit the accepted modification to the California Coastal Commission for the Executive Director’s determination of consistency with the Commission’s certification order. After concurrence by the California Coastal Commission at their next regularly scheduled public hearing, their approval will be forwarded to HCD for their final certification.
California Coastal Commission Submittal
The public record for the 2013-2021 Housing Element Update was submitted to the California Coastal Commission on March 18, 2019 as part of the request for a Local Coastal Program Amendment. Exhibit 1 of the Cover Letter included an itemized list of the documents included in the public record packet.
HCD Submittal
The 2013-2021 Housing Element approved by the City Council at its March 13, 2019 meeting, was updated to reflect its action and was submitted to the State Department of Housing and Community Development (HCD) on March 15, 2019 for its review. The HCD findings letter for Encinitas’ adopted housing element was received by the City on April 25, 2019.

- Section 1: Housing Element Policy Program – contains the policy program for the Housing Element
- Appendix A: Community Engagement Summary – provides a summary of community engagement activities conducted and community comments
- Appendix B: Housing Profile Report – provides the requisite analysis of housing need, constraints and resources pursuant to housing element law
- Appendix C: Adequate Sites Analysis – provides the requisite analysis for the provision of adequate sites to accommodate the City’s RHNA need

HCD Review – February 4, 2019
HCD submitted their Review Letter on February 4, 2019, regarding their review of the City of Encinitas’ 2013-2021 Draft Housing Element submitted to HCD on December 21, 2019.

The Housing Element Update Identifies:
- Policies for new housing construction, rehabilitation and conservation of the existing affordable housing stock
- Strategies and programs focusing on: housing affordability, substandard housing rehabilitation, existing demand for new housing, eliminating housing development constraints, and maintaining an adequate supply of rental housing.
- Sites suitable for lower income housing that will be up-zoned to 30 units per acre.
