On January 17, 2024, the Encinitas City Council adopted Ordinance 2023-07, adding Chapter 9.85 - Shopping Cart Ordinance to the Encinitas Municipal Code.  The purpose of this chapter is to promote the public health, safety, and general welfare of the community by requiring owners to contain shopping carts on their premises and to make it unlawful for a person to remove a shopping cart from a premises.

The Shopping Cart Ordinance has been developed around a framework of shared responsibility including the City of Encinitas, community members, and Shopping Cart Owners to prevent abandonment of shopping carts and related impacts.
